Henry charged, but state drops two

Bengals wide receiver Chris Henry has been formally charged with one felony gun count and still faces possible jail time and a potential NFL suspension, but he received some encouraging news when two other felonies were dropped by an assistant state attorney in Orlando, Fla., for failure to show probable cause.

Looks like Henry either lucked out or got a "helping hand" somewhere along the line. Hobson's report on da site says they didn't have the penalty available. Fortunately, there's this cool new research tool called "yahoo" that someone should clue Geoff in about...

A person who carries a concealed firearm on or about his or her person without a license commits a felony of the third degree, which is punishable by up to 5 years imprisonment and a $5,000 fine. Section 790.01(2), (3); see sections 775.082(3)(d) and 775.083(1)© for penalty provisions.

Just carrying a concealed firearm doesn't appear to trigger any mandatory jail time under Florida gun laws. He'll get fined, probation time, and severely -- severely, mind you -- slapped on the wrist.

Then he gets to go face Marvin...

Having two Chads (once Henry has gotten more experience and hopefully grown a brain) and a T.J. on the same offense will be rediculous... With Palmer and Rudi/Perry AND a potential tight end upgrade, and a top three offensive line... can there be an offense better than that? I smell a Superbowl. :)

It is good news ultimately - but we may not see him for a while still.

Hope he gets probation, a major fine and some community service etc..., but I'm guessing the NFL will come down hard on him possibly with a major suspension (4-16 games).

I'm sure he'll be happy to see Marvin, who will probably give him one more chance not to screw up (double secret probation). I just don't see Marvin as some big tough guy coach like Parcells, he's actually more of a Bob Huggins' type - loud and boisterous at times on the field, no nonsense to an extent, but ultimately a player friendly coach who treats players like adults/professionals, and gives them 2nd chances etc..., if this were Coughlin or Parcells' team, he'd be gone by now I'm guessing.

I'm not knocking Marvin at all, don't care what his style is as long as he wins, just not sure where the idea comes from that Marv is some sort of strict authoritarian who treats players like college/high school kids. He's actually a pretty tolerant coach (see Chad).

I think Marvin is much less tolerant of guys who just don't fit in or work hard.

Hobson's an idiot.

If the charges were dropped by the prosecutor it wasn't because he "failed" to do anything. The word "failure" indictates a ruling by a judge. At this stage in a case, the only involvement of a judge would be to issue a search or arrest warrant. And the only "probable cause" involved would be the reason the cop had for arresting the guy in the first place. And having the guy commit the crime right in front of your eyes is near-perfect PC for an arrest.

On the other hand, charges "dropped" by the prosecutor can be picked up anytime in the future. But technically speaking, the prosecutor didn't even "drop" the charges because he never charged them in the first place.

Unless Henry's got a deal in the works, this case is far from over. And clearly Hobson is not the person to be informing the fans about it.

I'm still a huge advocate to have Henry back at some point next year. I love watching the kid play and all you can hope for is someone knocking some sense into that 6 year old head of his. I see him getting a pretty good suspension next year as well. If I had to guess an exact amount, I'd say 8. Just in time to have us make a playoff run !!!

Hell! all he did was point a gun with armored piercing bullets,while wearing a Bengal Jersey, at a crowd of people......no real harm done. I'm sure he said he was sorry and those people were nobody I new WTF!

I've not been following this story. Did he really have armored piercing bullets or are you just confused? Its been my experience that a lot of people will confuse full metal jackets or hollow points as armor piercing bullets.
