Bengals defensive end Justin Smith pleaded not guilty to driving under the influence Tuesday in Kettering Municipal Court, according to a report on CBSSportsline.com.

Now that is being in denial! He blew a what? .155??

I know, I know, some slick lawyer will get him off. First offenses, without personal injury or property damage, probably doesn't get punished that severly anyway. Even for us nobodies!

In a case where the BrAC is .15, the only option the defense has is to attack the police officer or the breath testing instrument. To give you an idea of how intoxicated a person is at .15 BrAC, the average novice drinker will be throwing up. At a .20 BrAC, the intoxicated person will have double vision.

A decent prosecutor should have no problem getting a conviction. At this point, the defense attorney probably advised him to plead "innocent" in order to set up a plea bargaining arrangement. Plus, this gives the defense attorney the opportunity to make more money in fees charged.

According to NFL policy regarding a first offense in an alcohol-related matter, if Smith is convicted or admits a violation of law, Commissioner Paul Tagliabue can fine him, suspend him, or take other “appropriate” action.

The policy also states that “absent of aggravating circumstances,” a first offense is generally fined not more than $20,000 and doesn't usually involve a suspension

By pleading innocent, Justin is far less likely to be suspended by the league. He'll probably get a plea bargain, and plead guilty or no contest to a lesser charge, thus avoiding suspension by the league. Had he pleaded guilty and got the DUI conviction, I would imgine he probably would have wound up missing a couple of games.

If they give Smith more time than Jamal "Coke" Lewis, then I say we start a fan revolt against the NFL.

I think the NFL has been losing credibility each year with their "moral obligations" of promoting minor penalties for felonious infractions. There needs to be stricter guidelines for issues such as a 4-game suspension for smoking pot (not even a misdemeanor unless you're caught with some) having MORE of an infraction than a 2-game suspension for a felony.

Sorry, but this sounds extremely hypocritical.

As for the DUI thing; at the rate the NFL imposes infractions, Smith should be forced to sit out 1 quarter. After all, this is a precedence established by the NFL elite.

The NFL PLayers Union and player's agents has the league wrapped around their Ferrari's.

Justin will probably get a modest fine, community service and no game suspensions. For the 1st offense with a good track record I really have no problem with that. I would want the same consideration. If I got popped a second time I would expect to get nailed.

Now if I was caught brokering a coke deal or assisting in the buy, which was obviously meant for distribution, I would expect to be someone's bitch in prison.

Goes on in all sports. Look at baseball: Darrel Strawberry got popped for coke how many times? And was still allowed to play after rehab. Pete Rose gets nailed for gambling...gone for life. If he bet against his team, I would say good riddance. If he bet on other games (not involving his team) and bet on his team to win...that's no where near as bad.

Hmmm. Someone else around here was saying something just like this awhile back in the Reds Forum. I just can't remember who the heck it was! :rolleyes:
